Terms of Service

1. Acceptance

By accessing or using Zulma (the “Platform”), you (“Customer” or “you”) agree to these Terms of Service (the “Terms”), entered into with Zulma Resources Inc. (“Zulma”, “we”, “us”), an Ontario corporation. If you do not agree, do not use the Platform.

2. Service description

Zulma operates a technology platform that connects Customers seeking residential cleaning and lawn careservices with independent contractor service providers (“Crew” or “Cleaners”) serving the Niagara region of Ontario, Canada. Zulma owns the Platform, the booking infrastructure, the brand, and the Customer relationship; Crew perform the services in their independent capacity.

The Platform may add or remove service categories from time to time. Service availability varies by municipality and season; lawn care availability in particular is seasonal (typically April through November in the Niagara region).

3. Eligibility

You must be at least 18 years of age and have the legal authority to enter into binding contracts in the Province of Ontario to use the Platform. You must provide truthful, accurate, and complete information when registering an account.

4. Account registration

You are responsible for the security of your account credentials and for all activity under your account. Notify us immediately at hello@zulma.ca if you suspect unauthorized access.

5. Booking and payment

  • Prices displayed on the Platform are in Canadian dollars (CAD). HST is itemized on every quote before you confirm.
  • Same-day, weekend peak, and other dynamic adjustments are presented as transparent dollar amounts on every quote. No hidden fees.
  • Two payment models are supported and clearly labelled at checkout:
    • Card pre-authorization (default when card payments are enabled): your card is pre-authorized for the quoted amount when you confirm the booking. No charge is captured until a Crew member accepts the job. If no Crew member accepts in time, the hold is released.
    • Pay on completion (current beta default): no card on file is required; you settle with the Crew member after the visit (cash, e-transfer, or invoice).
  • Recurring bookings (weekly, biweekly, monthly) lock the agreed per-visit price for the duration of the schedule, subject to material changes (e.g., a service-area-wide rate adjustment) communicated at least 30 days in advance.
  • Receipts are issued in compliance with the Canada Revenue Agency (CRA) requirements for HST documentation.

6. Tips

Tips are entirely optional. When you add a tip through the Platform, 100% of the tip amount goes to the Crew member who performed the work. Zulma takes no portion of any tip. Tips are settled separately from the base service price and are not refundable once paid.

7. Cancellation and refunds

The cancellation fee depends on the timing of your cancellation:

  • Before any Crew member accepts: no charge; authorization fully released.
  • 2+ hours before scheduled time: no charge; full release.
  • 1-2 hours before: $30 late-cancel fee paid to the Crew member who blocked their time.
  • Less than 1 hour before: 50% of the booking total.
  • After Crew arrival or job start: full charge applies.

Crew members may cancel a job with notice; if a Crew member cancels more than 30 minutes before scheduled arrival, your authorization is released in full and we'll work to rebook you.

8. Weather and force majeure

Lawn care visits in particular are weather-dependent. Zulma or the assigned Crew member may reschedule a visit at no charge to you when weather makes the work unsafe or ineffective (active rain, lightning, snow on bare ground, wet grass that would clump, ice, etc.). We'll notify you the night before or as soon as conditions develop, and reschedule to the next available dry day in your window.

Beyond weather, neither party is liable for delays or non-performance caused by events outside reasonable control: power outages, government orders, network outages, civil disruption, or natural disaster. We'll make a good-faith effort to reschedule and refund pre-authorizations promptly.

9. Customer + crew obligations

As a Customer, you agree to:

  • Secure cash, jewellery, prescription medications, firearms, and irreplaceable items before the Crew member arrives. Items left in the open are presumed not valuable for claim purposes.
  • Provide a safe and accessible work environment.
  • Disclose pets, hazards, and special instructions.
  • For lawn care: ensure gates are unlocked or share access details, and keep pets indoors during the visit.
  • Treat the Crew member with respect and dignity.

Crew members agree to:

  • Arrive on time, in clean attire, with appropriate supplies and equipment.
  • Complete the agreed scope of work to professional standards.
  • Capture before/after photos where reasonable and where the Customer has not opted out (see Photos section below).
  • Treat your home, yard, and possessions with care.
  • For lawn care: comply with all applicable municipal bylaws on noise, equipment hours, and waste disposal.

10. Lawn services: noise + bylaws

Most Niagara-region municipalities restrict use of gas-powered or amplified equipment outside of standard daytime hours (typically 7:00 a.m. to 9:00 p.m. on weekdays, and slightly later starts on weekends). Zulma Crew members will not arrive before the earliest local allowed start time without explicit Customer permission and confirmation that the property is detached enough that neighbours won't be disturbed.

If your municipality enforces stricter rules (e.g., Sunday bans on power equipment), let us know in your booking notes and we'll route accordingly. Customers are responsible for checking their own municipality's noise bylaw if scheduling outside of standard hours.

11. Photos

Crew members may take before/after photos of the work areas to document quality, protect against false damage claims, and improve service. Photos are stored privately, accessible only to you, the Crew member, and Zulma support, and are deleted within 30 days unless attached to an active dispute.

You may opt out of photo capture at any time by leaving a note on the booking. Crew members will respect your wishes; if a dispute later arises and there are no photos, we'll resolve it on the available evidence.

12. Insurance

Zulma maintains:

  • Commercial General Liability insurance with $2,000,000 in coverage for third-party property damage and bodily injury arising from Crew negligence while performing services booked through the Platform.

Independent contractor Crew members are responsible for their own equipment, vehicle, and any insurance they choose to carry beyond Zulma's policy. WSIB coverage for domestic-residential cleaning and lawn services is not mandatory in Ontario; Crew members may register for WSIB voluntarily.

Coverage is subject to the terms and conditions of the applicable policies. Damage claims must be reported within 48 hours of service through your booking detail page. Suspected theft must be reported within 24 hours and to local police. Help Center has the full claim process.

13. Limitation of liability

To the maximum extent permitted by Ontario law, Zulma's aggregate liability arising from any single booking is limited to the greater of (a) the price paid for that booking and (b) the proceeds available under our insurance and bond. Zulma is not liable for indirect, incidental, special, consequential, or punitive damages.

Pre-existing damage is not covered; we encourage a brief pre-clean walkthrough between you and the Cleaner.

14. Disputes

Most disputes are resolved through our internal process. File a report from your booking history within the applicable window:

  • Property damage: within 48 hours
  • Missing items: within 24 hours
  • Quality issues: within 24 hours; re-clean guarantee
  • Cleaner conduct: within 72 hours
  • Billing discrepancies: within 7 days

Disputes that cannot be resolved internally within 7 days may be referred to mediation in Ontario. Either party may seek relief in the courts of Ontario.

15. Independent contractor relationship

Crew members using the Platform are independent contractors, not employees of Zulma. Crew members set their own hours, may accept or decline work without penalty, may work for competing services, and may send qualified substitutes (subject to capability + background-check verification). Zulma provides the platform, brand, dispatch, and customer relationship; Crew members provide the work.

Tax treatment: Crew members are responsible for their own income tax, CPP contributions, and (where applicable) HST registration and remittance. Zulma issues a T4A annually for any Crew member earning $500 or more in a calendar year, summarizing total payouts.

16. Intellectual property

All Platform content, branding, software, and trademarks are owned by Zulma Resources Inc. or its licensors. You receive a limited, non-exclusive license to use the Platform for its intended purpose. Reverse engineering, scraping, or redistribution is prohibited.

17. Modifications to these terms

We may revise these Terms from time to time. Material changes will be communicated by email or in-app notice at least 14 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance.

18. Termination

You may close your account at any time from Account. We may suspend or terminate access for material breach, fraud, or risk to other users, with notice where reasonable and consistent with applicable law.

19. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. The courts of Ontario have exclusive jurisdiction over any disputes arising from these Terms or your use of the Platform.
